ILLEGALITY OF FORCED OR COMPULSORY LABOR IN ACCORDANCE WITH SECTION 34 OF ’99 CONSTITUTION
The dignity of labour is the hallmark of anyone, which boosts the productivity of the society.
Slavery is against the constitution to make someone a slave or force anyone against his wish to serve slavery has been modernized, which is defined as when an individual is exploited by others for personal or commercial gain. Modern slavery whether tricked, coerced or forced, they lose their freedom.
CHILD LABOR: A FORM OF CRIME AGAINST HUMANITY.
Child labor is another form of modern slavery, it occurs when a child is exploited for someone else’s gain. This includes child trafficking, child soldiers, child marriage and child domestic slavery. Modern slavery operates as “hydra-headed monster in the form of human trafficking which involves the use of violence, threat or coercion to transport, recruit or harbor people in a place. The practice of slavery is one with a long and ignoble history across nationalities, cultures and religion. It occurred in ancient civilizations in places like Babylonian, Assyria, Egypt, China, Roman Empire. On December 10,1948, the United Nations General Assembly adopted the Universal Declaration of Human Rights, which official ended slavery, yet the bestial practice has resurfaced and is still thriving in modern forms seven decades later.
It is slavery to send a young boy to work in a sugarcane farm.
It’s forced or compulsory labour so long as the person is working against his wish and does not have the choice of leaving that job at his convenience.
CASE 1; A trader at Bodija market informed me that for a few months, an under aged girl from a francophone West African country was working with a food vendor. The said girl was brought by a woman. According to the brief l got, the wage of the underage will be paid to the said woman. As soon as i got the information, l waded into the matter by informing JDPC, a lawyer was intimated, the said counsel visited the police station where the girl was detained for safety. LIMITATION TO RIGHT TO DIGNITY OF HUMAN PERSON; There are restrictions or exceptions to forced or compulsory labour.(1) whenever a court of competent jurisdiction issued an order by sentencing an offender to imprisonment with hard labor. A court can issue an order to offenders to perform some labour as punishment. In these circumstances, the right to human dignity cannot be enforced.
In armed forces or police: compulsory labour may be the requirements to be fulfilled before you can be endorsed into the state security operative.
Compulsory labour may be part of the training program, the constitution does not guarantee the right to human dignity.
NO DOUBLE JEOPARDY IN CRIMINAL MATTER: CASE 1: Suntai was arrested and charged before a court of law for assault, tried and sentenced to imprisonment for that offence. Suntai cannot be tried again in the future for the same offence or a similar offence having similar elements as the same ingredients as the one for which Suntai was convicted. The principle is applicable to discharge and acquittal by the court.
