Your Right To Remain Silent or Avoid Answering Any Question When Arrested Until Your Lawyer Or Other Person Of Your Choice
Whenever you are arrested or detained for any charge by any security operatives – the Economic and Financial Crimes Commission, {EFCC}, Police, Independent Corrupt Practices and Other Related Offences Commission {ICPC}, Nigeria Customs Service, Department of State Service {DSS}. Assert your constitutional right that u would not provide an answer to any question or write any statement until you consult with person of your choice. Don’t abandon your right when you are harassed or intimidated, no uniformed men will give you that right unless you insist on it.
In a situation when you are insulted, derided or cajoled, keep asserting your right in their presence politely. Understand the fact that, you are not the author of the constitution. Therefore everyone is subject to the constitution including the DSS, Police.

Section 35(6) states that: “Any person who is unlawfully arrested or detained shall be entitled to compensation and public apology from the appropriate authority or person; means an authority or person specified by law. There are hundreds of Nigerians who are illegally detained by EFCC, Police,DSS in their various detention facilities.
Limitation to Right to Personal Liberty
There are exception to right to personal Liberty. In a case of capital offence such as murder,armed robbery, kidnapping and so on, Anybody charged with capital offence is not entitled to be released If not tried by the court within 2 or 3 months.
